Mortgage co. bankrupt

That should not be a problem. Someone else will take over collecting your payments, possibly a bankruptcy trustee. You should receive a notice.

What will happen to my 20 foot trailer if I filed chapter 7?

Answered by attorney Marjorie A. Guymon
Bankruptcy lawyer at Goldsmith & Guymon, P.C.
If the persons who lent you the money to purchase the trailer hold a lien against it then they are protected. You must continue to make the payment to them or they have the right to seize the trailer as payment. The balance would be discharged. If they do not hold a lien then your only option is to claim the trailer exempt under the tools of the trade exemption, which has a $10,000 limit.

In a Chapter 7 Bankruptcy, when I pay it off is it truly mine and they can't claim anything?

Susan Green Taylor
Answered by attorney Susan Green Taylor (Unclaimed Profile)
Bankruptcy lawyer at Law Office of Susan G. Taylor
You shouldn't have any problems. In my jurisdiction I would have filed a motion to have the judge rule the mortgage company waived any right to take adverse action (like failing to report your payments to a credit bureau, etc.) due to failure to execute a reaffirmation agreement because it was their fault none was ever filed. But don't worry it's still your house.
