If my mom filed bankruptcy and I was trying to sell the house I inherited, does that mean I have to pay her debt even?

Well, talk about a question that is as clear as mud. Did you inherit the house from your mother or did you inherit it from someone else? Do you inherit the house through probate or because your name was on the title as a joint or co-owner? How long ago did your mother file bankruptcy? Was it chapter 7 or chapter 13? Was the bankruptcy completed by a discharge order? Or was the bankruptcy still open and pending? All this questions are crucial to get an accurate answer to your question. I am not a Magic 8 ball that gives you answers randomly that say nothing.

Can a landlord file eviction if a person is under chapter 13?

If a landlord proceeds with an eviction against a person in Chapter 13 without bankruptcy court approval, the bankruptcy court can impose sanctions to penalize the landlord and the eviction court will not be allowed to enter an order granting the eviction. Better retain a bankruptcy creditor's attorney to begin the process of obtaining permission.

When filing a Chapter 7 bankruptcy schedule J, if your monthly debt exceeds your monthly income, what happens?

Answered by attorney Sanaz Sarah Bereliani (Unclaimed Profile)

Nothing that is good. If your monthly income was greater than your monthly expenses you wouldn't qualify for chapter 7 because you would show that you do have enough money to pay your creditors. In chapter 7 you are asking for a discharge, stating that you do not have enough income to cover your monthly expenses and also your debts.
