Do I owe property taxes if they were listed in my bankruptcy?

Charles J Schneider

Bankruptcy lawyer at Charles J. Schneider, P.C.
Property taxes are a lien against your home. A chapter 7 discharge does not discharge the lien. To keep your home you must pay your taxes.

How will my Chapter 7 bankruptcy effect our tax return?

Bankruptcy shouldn't affect your tax return, but you may have to provide your bankruptcy trustee a copy of the return and turn over any refund to the trustee. Unless all of the refund was claimed as exempt on your bankruptcy petition, you will be required to give the refund check to the trustee to distribute to your creditors. Any portion that belongs to you will be returned to you.

If I haven't worked in a couple of years, how do I file for a chapter 7 bankruptcy?

You do need to list your wife's information as it's household income but her social will not be on your bankruptcy and this bankruptcy will not be on her record. She can file a chapter 13 in the future, if necessary. I would recommend consulting with a bankruptcy attorney regarding your options and a game plan for you and your wife.
