Your marital status and the fact that you live apart does affect the kind of paperwork you need to fill out when you file for bankruptcy. You will need to indicate that you have separate living expenses on your bankruptcy petition, but you will also probably need to disclose your ownership interest in your marital home, as well as your liability on the mortgage. You will need to obtain information on the balance left on the mortgage and what the value of the house is in order to determine if there is any equity in the home. If there is equity in the home, the bankruptcy trustee may pursue it and try to take the home to pay some of your creditors if you do not plan properly. You can probably obtain the mortgage balance by calling the bank or pulling your credit report, if your name is on the mortgage.

Your joint ownership of his teen account will not affect his credit even if you file bankruptcy. You do need to disclose the existence of the account in your bankruptcy papers to protect the balance from your creditors, however. If this account is located at a Credit Union to which you owe money, there may be an issue, however. Please see an attorney before you file.
