Will a Chapter 13 Bankruptcy motion help me get relief from automatic stay?

If your plan contemplated continuation of the lease and you can't make the payments, the landlord will probably prevail on its motion for relief from the stay unless you have a good reason for the default and are prepared to make up the unpaid rent. austinh@ix.netcom.com

Can I file bankruptcy if I was sued in a civil suit?

You need to read the judgment. You cannot discharge a debt that results from willful and malicious injury to another. If you live in another state, the plaintiff can register it as a foreign judgment and try to collect.

Can I include dads funeral costs in my bankruptcy?

Answered by attorney Kevin W. Bruning (Unclaimed Profile)
Bankruptcy lawyer at Bruning & Associates, P.C.
If you are going to file bankruptcy or going to convert from a chapter 13 to a chapter 7 bankruptcy, then you should include the funeral bills as part of your bankruptcy. You will then no longer be liable for those expenses. However, if you had co-signors such as other family members, they will still be liable for that debt, including "your portion," unless the bill was somehow divided up so that each of you had to pay a separate amount, which is highly unlikely.
