If I filed for bankruptcy, do I still have to pay child support?

Answered by attorney Stuart M. Nachbar
Bankruptcy lawyer at Law Office of Stuart M. Nachbar, P.C.
IN NJ: Yes, even if you file for Bankruptcy, you still have to pay child support. Pursuant to the Bankruptcy Code, child support is special, and you must continue making all Domestic Support Payments which includes alimony and child support. If you are filing a Chapter 13, in NJ, you must sign Certification stating that you are current on your Domestic Support Obligations before the Court will confirm your Plan.

Is a 401k loan exempt under chapter 13 bankruptcy?

Answered by attorney Dorothy G. Bunce (Unclaimed Profile)
Bankruptcy lawyer at A Fresh Start
You are not allowed to borrow any significant amount of money while in a Chapter 13 because it reduces the amount you have available to pay other creditors. The fact that this asset is exempt is irrelevant because you have to pay the money back or quit your job. Nothing will happen to you immediately, but you can expect your Trustee to ask that you pony up more money in your plan payments.

Will I be taxed on what I have left on mortgage and will I be able to get another mortgage if I walked away?

You will not be taxed on any losses your lender sustained as a result of a foreclosure if you had previously filed bankruptcy which included the property. Whether you will be able to qualify to obtain another mortgage down the road if you go through a foreclosure will depend on whether the mortgage is federally insured (typically FHA or VA) and lending criteria at the time you are looking for another mortgage loan. If you can avoid a foreclosure by a short sale or deed in lieu of foreclosure, it is certainly going to be better for your credit & your future. Don't just walk away look for other options.
