If you got bad advice from a lawyer, you may have a case for the lawyer giving you bad advice. If you got bad advice from some other licensed professional, you may have a case against this professional for giving you bad advice. But if you took bad advice from someone without professional qualifications, your case is going to be more complicated. And will you be able to collect from this unregulated company? As far at the bank being responsible for having made the referral, I think pursuing the bank would be a stretch. But you may want to consult with a professional specializing in banking law.

If the case was dismissed, you need not wait at all to file under Ch. 7. However, you will need to file a motion to extend the automatic stay past 30 days from filing.
