Does a discharged bankruptcy qualify as an unsatisfied judgment?

Answered by attorney Austin M Hirschhorn (Unclaimed Profile)

If any unsatisfied judgments were listed in your 2001 bankruptcy case the answer to the question would be yes. If more detail is required you would indicate that you had filed for bankruptcy relief and received a discharge in 2001. If there were no unsatisfied judgments in existence at the time you filed bankruptcy, your answer would be no. In either event I don't believe that a 12 year old bankruptcy discharge would show up on a credit report if one was needed as part of the application for a real estate license application.

Can I file bankruptcy on the IRS if I go ahead and file?

There are several rules regarding the discharge of taxes in a bankruptcy. One of those rules is the taxes must be at least 3 years old. You could do a Chapter 13 to create a payment plan on taxes but you could not get rid of them.

What's the best way to handle real estate bankruptcy?

Answered by attorney Dustin Douglass Deissner
Bankruptcy lawyer at Deissner Law Office, P.C.
Getting the house out of the Bankruptcy is easy: just arrange to pay off the mortgage either by refi or you cut a deal with the mortgage co. to take over and catch up, but good luck there. Bottom line: you have to make peace with the Mortgage Company. Usually once you're in a Ch. 13 they won't work with you any further, but they'll always be happy to get paid off. So in your case if your uncle wants to sell you the house, or you can take a quit-claim and refinance, you likely won't get much help from the mortgage holder. Probably will need BR court approval whatever you do. Talk to your uncle's BR lawyer.
