Are community credit unions exempt from obtaining relief from an automatic stay?

David Michael Benson
Answered by attorney David Michael Benson (Unclaimed Profile)
Bankruptcy lawyer at Benson Law Firm
Credit unions are subject to the automatic stay, just as all creditors are. If the credit union failed to get permission from the judge via a motion to lift the automatic stay, it may have violated the law and may be subject to sanction. If you do not have an attorney, now would be a good time to consult with one.

What can I do after my 7 years from the bankruptcy are up?

Answered by attorney Loren Paul Zahn (Unclaimed Profile)
Bankruptcy lawyer at Zahn Law Office
While your bankruptcy will come off your credit report in 7-10 years, you need do nothing to have it removed. It will come off automatically. Additionally, you can seek loans while still having a bankruptcy on your credit report. If your credit is otherwise good, you should have no problem with obtaining an auto loan, although your rate may be higher.

Can I file for chapter 7 bankruptcy on a Heloc loan?

Madhu Kalra
Answered by attorney Madhu Kalra (Unclaimed Profile)
Bankruptcy lawyer at Kalra Law Firm Professional Corporation
If you want to keep the house and you file chapter 7 Bankruptcy, unfortunately, HELOC (Line of Equity) will continue to remain undischarged in chapter 7 bankruptcy. I would recommend seeking appraisal of the property. If the mortgage loan of 1st Trust Deed holder exceeds the home value, you should consider chapter 13. chapter 13 bankruptcy will allow you to strip the 2nd line of Equity and be paid in chapter 13 plan, as unsecured debts. Its advisable to consult bankruptcy and consider your options, chapter 7 vs. chapter 13.
