The answer is "it depends." What is your boyfriend's income? If your income together adds up to more than the median amount, you may not be eligible to file Chapter 7 bankruptcy after you get married. On the other hand, if your income is high and you support him, you may want to claim him as a dependent to be eligible to qualify to file Chapter 7. No need to get married first if you support him. Does your boyfriend own any assets? In many states, not Nevada, a Wife acquires an ownership interest in her spouse's property when he says "I do." Requiring him to forfeit his property because of your bankruptcy probably won't start the marriage off on a happy note.

Yes and you need to send the foreclosure trustee proof of your wife's title ownership and reference the trustee's sale number. Your wife needs to confirm with the foreclosure trustee receipt of the proof of bankruptcy filing and of proof of her legal interest in the property. Anyone with a legal interest in the property can stop a foreclosure filing bankruptcy case. One scheme is to transfer title of the property just before the transferee filing a bankruptcy case to stop the sale. The bankruptcy court considers that an abuse of the automatic stay and may dismiss the bankrutpcy case as being filed in bad faith. It will stop the sale but there are serious consequences when the bankruptcy court determines abuse and bad faith. However, if your wife has owned the house for a long time then her filing bankruptcy will stop the trustee's sale and it would be legitimate for her to file to stop the sale and maybe save the house by giving you more time to do a loan modification.
