What can I do if my son is deceased and federal student loan agents are calling (harassing) me for repayment of these loans?

Answered by attorney Daniel A. Edelman
Bankruptcy lawyer at Edelman, Combs, Latturner & Goodwin, LLC
You are not liable for another's loan unless you signed for it. Inform the people calling in writing that the borrower is deceased and instruct them not to contact you. If they try to collect from you or disregard the instruction, and they are a debt collector, the attempt violates the Fair Debt Collection Practice Act.

A company I gave my credit card to says they never billed me, should I pay them again?

It depends upon more facts.. Generally you need to check your credit card billing statement to be sure they did not bill you .. if they did not charge you you should probably pay.. but I would not pay interest because they have no right to interest because you tendered payment then and they did not collect so the interest is their fault. If you filed bankruptcy or anything then no you do not have to pay.

How can I add debt that has incurred after one year into the bankruptcy?

default-avatar
Answered by attorney Roger J Bus (Unclaimed Profile)
Bankruptcy lawyer at Debt Relief Law Center
No. All you can do is file a Petition to Amend and hope that the creditor voluntarily agrees to file a late filed claim in your Chapter 13 case that the Chapter 13 Trustee does not Object to for being late filed. If the filing of the claim does not effect the amount paid to other creditors, the Trustee may just let it come into the Plan.
