Do I need a minimum amount of debt to file a personal bankruptcy?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
Bankruptcy lawyer at Richard B. Jacobson Associates, LLC
Bankruptcy is a federal matter-and the state has only a small role to play. No state can require a certain amount of debt for you to be free to exercise your right to file bankruptcy. While $9,000 is not a huge load of debt to many people, it may be an unacceptable burden to you. Nothing I know of keeps you from filing a bankruptcy petition with that amount of debt. That said, it's always a good idea when you're about to get involved in a court matter to hire a skilled lawyer.

Can you file bankruptcy on a civil lawsuit and if so can I also file on my credit card?

Answered by attorney Margaret L. Evans (Unclaimed Profile)
Bankruptcy lawyer at Law Office of Margaret L. Evans, PC
You must include every single creditor on your schedules and petition; the vehicle and the credit cards must all be disclosed; depending on where the suit is, you may also need to file the appropriate motion(s) to have the lien discharged as well.

How can you get a property lien removed after discharge from bankruptcy?

William H Nebeker
Answered by attorney William H Nebeker (Unclaimed Profile)
Bankruptcy lawyer at Havens Law, LLC
If the lien is attached to the property, then there is no way to remove it although you are no longer legally liable for the debt. If you need a lien removed you need to make a motion to do so during a bankruptcy case. If you need the lien removed you should contact an attorney about how to proceed.
