What should I do if in bankruptcy and non reaffirmation on house?

Susan Green Taylor
Answered by attorney Susan Green Taylor (Unclaimed Profile)
Bankruptcy lawyer at Law Office of Susan G. Taylor
Unfortunately, you are not getting credit for your good payments on a credit report. But you do enjoy some benefits of ownership. If you have equity in the home, you can recoup that when you sell. If you were upside down on the house when you filed bankruptcy, the judge would have advised you against reaffirming and might have denied it, had he been asked to decide. I'm terribly sorry they refused to refinance, but at least you can never be held personally liable for the debt if you move on.

Am I now responsible for these bills even though a chapter 7 was filed?

f you are liable on the debts, they can only now go after the other parent. Depending on the decree, you may have the option of going after your ex-spouse through the divorce. But they cannot go after her for debts before she filed bankruptcy.

What can I do if my husband was arrested because he didn’t show up for court and he owes $2988.34 for a car?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
Bankruptcy lawyer at Richard B. Jacobson Associates, LLC
You could pay the balance due. Or you could try to negotiate with the lender. Or you could offer to return the vehicle in return for cancellation of the debt. Or your husband could file a bankruptcy-but he would still have to pay for the car or surrender it to the creditor.
