There is currently an appeal pending that will decide the issue but for most judges in the central district, you can file the next day. Remember, you won't get a Chapter 13 discharge but that's fine because you're not looking for a discharge but a repayment of the remaining amounts. This is called a Chapter 20.

Since the lawsuit was dropped, the case is over. Did you list the claim as an asset on your petition? If the actions that created the claim occurred before the bankruptcy was filed, then any such claim should have been listed on your schedule B. If you didn't list it and you continue to pursue this matter there could be a problem as the creditors in your bankruptcy are entitled to all non-exempt assets.
