No. Upon filing bankruptcy an automatic stay is put in place which prevents creditors from attempting to collect the debts.

How can i get a reaffirmation of my mortgage loan?

Jeffrey David Solomon

Is your case already closed? Then you would need to reopen the case if the court would grant such the motion. However, you should consult an attorney. There are serious drawbacks to signing a reaffirmation despite what seems to be benefits. If you cannot pay someday in the future, you are subject to a deficiency claim.

Will a creditor return my repossessed car, which was taken after I filed my case, if I ask, or do I need a court order?

Answered by attorney Mark J Markus
Bankruptcy lawyer at Law Office of Mark J. Markus
The creditor certainly isn't going to return the car on their own.  You need to at least inform them of the bankruptcy case and demand its return.  If they still don't comply, you will need to seek a court order against them for violating the automatic stay (or, if this is after your discharge was granted, for contempt of court).
