If the creditor will not return the garnishment funds collected with 90 days of filing, the debtor has to move the court to required it to return the funds.

Unfortunately, I am not sure what all you signed at the time. You should contact that dealership and ask your salesperson what you should do. You may be entitled to your deposit back as well.

Most payday loans are unsecured (meaning you didn't give them your car title or a second mortgage). Unsecured loans in a Chapter 13 are prevented from taking any collection activity during the life of the chapter 13 and are discharged at the end of the Chapter 13.
