Can I file for bankruptcy again?

You can always file again but these are specific time periods between when you can get discharged. This is dependent on what chapter you previously filed and the disposition.

What is the name of the form to amend?

default-avatar
Answered by attorney Eric Allen Maskell (Unclaimed Profile)
Bankruptcy lawyer at Law Office of Eric A. Maskell
It all depends on the type of creditor. If it is an unsecured creditor you would need to amend Schedule F to list the creditor. If it is a secured debt then you would need to add them to Schedule D and amend that. If they are a priority creditor you would need to add them to Schedule E. Once you add them and amend the schedule you should also file an amended creditor matrix so that when the case is discharged the court will mail them a copy of the discharge order.

How long between filing chapter 7 can you file again for it?

Katie Marguerite Miller
Answered by attorney Katie Marguerite Miller (Unclaimed Profile)
Bankruptcy lawyer at Law Offices of Katie M. Stone, P.A.
You are not eligible to obtain a discharge in a Chapter 7 bankruptcy until 8 years have passed from the commencement date of the last bankruptcy you filed.  You are eligible to file a Chapter 13 bankruptcy and receive a discharge 6 years after the commencement date from your last bankruptcy you filed.  I hope you found this answer useful.
