If bankruptcy didn't reaffirm my home, can I still walk away anytime?

Melissa Ann Botting
Answered by attorney Melissa Ann Botting (Unclaimed Profile)
Bankruptcy lawyer at Law Office of Melissa A. Botting
In Texas, you can walk away at any time because of our constitution. You have no personal liability on the loan. That is why you cannot reaffirm a home mortgage in Texas. Reaffirmation means accepting personal liability for the mortgage and agreeing that you will not walk away in the future.

Which bankruptcy do I need to file to help me with my mortgage?

Answered by attorney Kathryn Ursula Tokarska (Unclaimed Profile)

Without knowing more about you and your situation it's difficult to say which chapter of bankruptcy is appropriate or even if it is possible to prevent the foreclosure with bankruptcy. Most bankruptcy attorneys offer free consultations. Be prepared to answer questions such as: how much income does the household earn, how much does the household need to spend on living expenses, what types and how much debt you have, past due amounts on any your mortgage(s), what types of assets you have. The devil is in the details. Talking to a bankruptcy attorney can help you formulate a plan.

If my lawyer did not include my car lease in my chapter 7, what should I do?

default-avatar
Answered by attorney Dorothy G. Bunce (Unclaimed Profile)
Bankruptcy lawyer at A Fresh Start
The car lender is lying to you about taking the car if your payments are current. And it is too late to obtain a reaffirmation, which by law must be submitted to the court before the discharge is entered. You should have read your entire bankruptcy petition before it was filed and let your lawyer know that a creditor was missing, if in fact it was missing. Look at Schedules D or G of your bankruptcy paperwork to determine whether this debt was included. If not included, it is now too late to make any changes. Talk to your own lawyer about the repercussions of this mistake of yours.
