First, you don't have a choice; all debts are included in a bankruptcy. It's not pick and chose like a restaurant menu. Second, if your house is worth more than the amount of the mortgage, selling would be no problem.

Bankruptcy after divorce

Answered by attorney Thomas Weiss

Good morning.  You can file for bankruptcy without affecting his home as long as you were not on the mortgage and you otherwise qualify.  If you are considering doing so and are located within NYC or Nassau or Suffolk County and would like to discuss it further, please give me a call.

Can the bank take my car if I file for bankruptcy?

Jeremy B Shephard
Answered by attorney Jeremy B Shephard (Unclaimed Profile)
Bankruptcy lawyer at David Andersen & Associates, PC
No. If you own a car free and clear then you would likely be able to exempt the car and keep it in a Chapter 7 proceeding. You are provided exemptions in a bankruptcy that allow you to keep so much "stuff."
