I cannot answer this question without additional information. If you had no equity in the bike, and it was not included in your exempt property, and you did not reaffirm the debt... the creditor still wants to get paid. If you make the payments and the debt goes away... they will never take the bike... it is yours. They only take the bike if you default on the debt.

You can do it either way, before the case goes to trial or after there's already a judgment. If you do it beforehand, however, you probably save the time/trouble/expense of having to go through the trial.

I would need additional information order to be able to give a firm answer. Generally, if only one of the parties is filing bankruptcy the entirety's property would not be affected, however in this case it appears that the parties have been divorced and therefore they no longer have a right to claim the former marital residence as entirety's property. I do not understand who we are. What did the judgment of divorce say regarding the former marital home. Was there ever quit claim deed? Was it recorded? I would suggest that the entire situation be examined by a practitioner who is familiar with and domestic and bankruptcy law. You are welcome to call my office for an appointment and would strongly suggest that you seek counsel before you make any determinations that you might later regret.
