Yes, the payday contract can say it. No, they can't enforce it. The debt can be discharged in bankruptcy. You can say whatever you want to say in a contract. Whether or not it can be enforced legally is a different issue all together.

If you filed a chapter 7 then yes. The key date is the date of filing. If you filed a 13 then keep in mind your new spouses income may affect your plan payment.

You sue in a court.. all 3 will be the same judge.If they actually do testify and commit forgery .. your attorney will be able to use the letter to show that they plan/threaten to commit perjury and forgery ... and it will impeach (discredit) their testimony and documents. It will be up to that Judge to get them on perjury .. you will not be able to.
