Can I file bankruptcy for the second time if my first filing happened in 2005?

Answered by attorney Max L Rosenberg
Bankruptcy lawyer at Rosenberg Hite, LLC
You are allowed to obtain a chapter 7 discharge of your debt once every eight years. If your discharge date is eight or more years ago, you should be able to file a new bankruptcy. Please make sure you file with an experienced bankruptcy attorney as filing pro se has to be one of the all time worst mistakes a person can do with their financial life.

If I got a subpoena in the mail, can I file bankruptcy without implicating my spouse?

A subpoena is a legal document requiring you to appear and testify. Bankruptcy would not change a requirement for you to testify unless your testimony is part of an attempt to collect a debt. While bankruptcy may be an option for you, it is not appropriate in many instances and other options may be available. I am not aware of any state where the laws require a spouse to become legally responsible for debts made before the marriage unless there was an agreement with the creditor to do so.

Do I have grounds to vacate this judgment due to improper service and if so, is there any way to recover my already garnished wages and stop it?

You would have to file a "Motion to Vacate a Judgment" with the Court showing both "justifiable neglect" for not responding to the Lawsuit plus you need to assert a "viable defense". (The reason that you do not owe the money). It will be up to the Judge at that point.
