Should I be worried if my mother files for bankruptcy and her name is on my car title?

Jeffrey David Solomon
Answered by attorney Jeffrey David Solomon (Unclaimed Profile)
Bankruptcy lawyer at Law Office of Jeffrey Solomon
Definitely do not pay off the car now, that builds up equity in the car. You could have a problem with the bankruptcy trustee if there is equity in the vehicle. She could claim that she just has bare legal title, really your car, but this depends on who paid for the car and its upkeep and insurance.

You bankruptcy lawyer can deal with this and you might even be entitled to damages for trying to collect a debt that was discharged in the Chapter 7 (if that is the case).

Can the mortgage company file a lien or is there a statue of limitations?

default-avatar
Answered by attorney Raymond Hillel Aver (Unclaimed Profile)
Bankruptcy lawyer at Law Offices of Raymond H. Aver, A Professional Corporation
The mortgage company should not be able to lawfully record a lien against your property without first filing a lawsuit against you and obtaining a judgment, both of which would be in violation of the discharge injunction in bankruptcy, based upon the facts set forth in your question. You should have a qualified bankruptcy attorney review your bankruptcy papers, the loan documents and the lien or whatever other documents are recorded against your residence.
