How long do I need to wait before I can do another chapter 13 bankruptcy?

If you have incurred new debt since filing in July, this may be an instance where you want to dismiss your case (or let it dismiss by not making payments) and re-file a new case. Of course, while you are out of bankruptcy, you will be without the protection of the automatic stay and will be subject to collections.

How do I know if I should file a chapter 7 or 13 bankruptcy?

Answered by attorney Tony E. Carballo (Unclaimed Profile)
Bankruptcy lawyer at Carballo Law Offices
You cannot afford to do it on your own but if you decide to do it on your own make sure you learn about bankruptcy by buying do-it-yourself book and reading it cover to cover before filing. While it sounds like Chapter 7 is what you need, no one can tell you that without a complete evaluation of your case, including knowing the types of debts you have and the income amont other important information required.

If I passed away do my children still get my house if I never reaffirmed my loan if I am current and never been late on any payments?

I'm not sure what you mean by "reaffirming" a loan. Generally, a loan lasts until the loan is completely repaid. However, if you still owe money on the loan on your house at the time of your death, that loan must be repaid first, before your children can inherit. If you have no other assets, your executor may have to sell the house to pay off the loan. Your children would then only receive whatever is left of the selling price.
