Am I able to replace the engine and re-tag the car without fear of repossession?

default-avatar
Answered by attorney D. Nathan Davis (Unclaimed Profile)
Bankruptcy lawyer at Davis Law Firm
As a general rule, the title holder would be able to repossess the vehicle and the engine in it. I would not replace the engine unless I had a clear title on the hulk.

Why is the entire company being considered for bankruptcy?

default-avatar
Answered by attorney Alan Emmerson Ramos (Unclaimed Profile)
Bankruptcy lawyer at Alan E. Ramos Law Offices
A corporation can be made up of many divisions or departments; however, they are all one company. So when the company files a bankruptcy petition, all of its assets (divisions, departments, etc.) are in the bankruptcy. In some situations, the divisions may be separate corporations (typically wholly-owned subsidiaries). In those situations, only the corporation filing is in bankruptcy, unless other subsidiaries also file.
