On the facts you have described, I would believe that the debt you owe to the insurance company could be discharged in a bankruptcy. You could wait and see if they sue you before filing a bankruptcy or you could file a bankruptcy now. However, it is possible that it could take a very long time before they sue youthey have to do it within six years of when you last made a payment. That's a long time to be in limbo. With very limited exception, student loans cannot be discharged in a bankruptcy. If you have to choose what payment to make, pay the student loan as that is not going to go away.

There is a short, easy and economical solution. File a brief, one-page amendment to your Bankruptcy Schedules, identifying the creditor. The Court charged $30 to file an amendment adding up to 5 creditors. Your BR lawyer should know how to do this, and the whole task takes about 10 minutes, perhaps less. If s/he will not take this small step to straightening things out, you can do it yourself. I will print out a blank basic form for this. Be sure to fill in all the information, and choose whichever district in which you are filing and see that it is correctly stated at the top. Send this to the Clerk of the BR Court in your District, together with a bank check or money order for $30.00. Of course, fill in your case number, the name and address of the creditor, the amount you believe this creditor claims, and the approximate time the debt was incurred. And of course you sign the paper. I could not copy it, but I will attach it, and hope you get it that way. Good Luck.

It is entirely illegal. There are both criminal penalties and the loss of your discharge if you try it. Do not even think of it. Instead consult an experienced reputable lawyer who might be able to help you achieve your goals lawfully.
