If I just filed chapter 7 and I go to court on May 6 and I need another surgery, can I add that to bankruptcy or postpone date for bankruptcy?

Answered by attorney Michael Jay Berger
Bankruptcy lawyer at Law Offices of Michael Jay Berger
You cannot add bills incurred post-petition to your bankruptcy case. You cannot postpone your bankruptcy case after you have filed it. Your options are to either (a) leave the post-petition bills outside your bankruptcy case or (b) move to dismiss your bankruptcy case and then file a second bankruptcy case later after your first case is dismissed and after your surgery.

A debtor has their rights and can do anything within the law to collect what id due them. If the RV is your only asset, then it is at risk.

Co buyer filing for chapter 7?

Charles J Schneider
Answered by attorney Charles J Schneider (Unclaimed Profile)
Bankruptcy lawyer at Charles J. Schneider, P.C.
None of your concerns about the accuracy of your co-buyer forms in their bankruptcy matter to you. Those inaccuracies, if any, cannot affect your right to keep the car if you continue to make your payments. The only thing that could happen that would affect your right would be to fail to make your payments or if there were non-exempt equity that a chapter 7 Trustee would seek to liquidate. The latter is unlikely if you owe more on the vehicle than it's worth.
