Can the bank take my car if I file for bankruptcy?

Keith Austin Wellman
Answered by attorney Keith Austin Wellman (Unclaimed Profile)
Bankruptcy lawyer at Wellman Law LLC
Whether your car would be liquidated in the Bankruptcy depends on the exemptions that would apply. When Kansas exemptions apply a vehicle worth up to $20,000 can be protected. Other states, such as Missouri at $3,000, have much less protection. If you've moved states within the last 2 years you'll probably want an attorney to assess what exemptions apply. Even in the situation where there is unprotected equity there are some reasonable options such as paying the equity yourself over approximately 6-12 months or paying the equity in a Chapter 13 plan over the course of 3-5 years. Finally, although you didn't mention whether the vehicle is still being paid on or otherwise has lien, it would have to be paid off even if filing Bankruptcy or the car could be taken.

Can I put my one day loans companieson my bankruptcy?

Answered by attorney Mark J Markus
Bankruptcy lawyer at Law Office of Mark J. Markus
You must list all assets and all debts in any bankruptcy case.  A failure to do so is grounds for denial of your discharge and, in egregious cases, criminal prosecution. I'm not completely sure what you mean by "put...on my bankruptcy".  If you're asking whether or not certain loans are dischargeable, that depends on the time of loan and how it was incurred. Debts incurred through fraud are not dischargeable in bankruptcy, as an example. However, most loans if not incurred through fraud or misrepresentation, are dischargeable in bankruptcy, including pay day loans (if that's what a one-day loan is). Mark Markus has been practicing exclusively bankruptcy law in California since 1991.  He is a Certified Specialist in Bankruptcy Law by the State Bar of California Board of Legal Specialization,  AV-Rated by martindale.com, and A+ rated by the Better Business Bureau.

Is there time limitation for HOA before trying to collect for past accounts?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
Bankruptcy lawyer at Richard B. Jacobson Associates, LLC
It's best to check with the lawyer who represented you in the Chap. 7. In general, HOA dues should have been discharged, although condominium dues are generally treated as secured, so you must be careful to distinguish the two. In any case, if the HOA dues were discharged, that cannot include the dues which accrued after you filed the Ch. 7. You'd do best to consult an experienced bankruptcy lawyer to be certain, or to do what needs to be done. Good Luck.
