Is the insurance company still requried to pay me the rest of my settlement? Do I need to get a lawyer?

Answered by attorney Mark J Markus
Bankruptcy lawyer at Law Office of Mark J. Markus
There's nowhere near enough information to answer your question.  Which bankruptcy chapter did the insurance company file?  Are assets being liquidated to pay claims?  Have you filed a claim?  How much are you owed? You need to consult with a bankruptcy attorney in the location where the bankruptcy case was filed for more information.  Mark Markus has been practicing exclusively bankruptcy law in California since 1991.  He is a Certified Specialist in Bankruptcy Law by the State Bar of California Board of Legal Specialization,  AV-Rated by martindale.com, and A+ rated by the Better Business Bureau.

How does getting married during a Chapter 7 bankruptcy affect the process?

You are tying to accomplish a complicated procedure in federal court without an attorney and you are looking to a volunteer attorney to advise you? Sorry, this situation requires you to have legal representation unless you don't care about the negative consequences. Nearly every person who self files bankruptcy loses property they could have kept had they been represented. You can listen to advice or learn the hard way!

Can I file chapter 7 without including the car?

David Michael Benson

No. All assets and liabilities must be included in your bankruptcy. And your father, as a co-borrower, would be entitled to notice.
