The short answer is "yes," but both incomes have to be considered for means testing, which determines your eligibility to file bankruptcy in the first place.

Many facts come to play in answering this question. Visit with an attorney in your state. In Idaho there are quite a few factors that can come into play and I expect it is similar in most other states.

Can I file bankruptcy in my name if the house is not in my name so that I can save it?

Answered by attorney Stuart M. Nachbar
Bankruptcy lawyer at Law Office of Stuart M. Nachbar, P.C.
If you inherited the house, it is yours and therefore the house would be part of the bankruptcy estate, which would stop the foreclosure sale. The problem is that the Chapter 7 Trustee may try to sell it, but it would give you some time.
