Am I still on my mortgage after filing for chapter 7 bankruptcy?

It is true they may need your signature to release the lien. The Chapter 7 will protect you from any liability.

How can I file for chapter 7?

Answered by attorney Stuart M. Nachbar
Bankruptcy lawyer at Law Office of Stuart M. Nachbar, P.C.
Please do not take this wrong, but you should go to an attorney. It is complicated and most people who file without representation (pro se) make mistakes that cost more to fix than it would have to hire counsel. Also, by hiring counsel, you have someone with you at the 341 Meeting and can make sure things go properly.

The family law order as to payment of community debts is enforceable against your ex spouse. You will have to seek a family court order to enforce this. Alternatively, you might want to consider filing bankruptcy. Consult with an attorney in this regard.
