1. You have to be served with a summons and complaint by a sheriff or process server. We do not have telephone service in Illinois. 2. Is this an Internet loan at more than 9% interest? If so, it is unenforceable unless the lender is a bank, credit union, or licensed lender. There are also substantial statutory damages for unauthorized loans. 3. Many calls of this nature are scammers. You should not respond or agree to pay or provide any information without a written notice describing the debt and giving your rights to dispute it.

There is an automatic stay upon filing a bankruptcy. There is no automatic stay when there is a non-residential, that is, commercial eviction.
