My husband and i were granted bankruptcy 6/2011, our home was included. when do we have to vacate the property?

Answered by attorney Michael D. Siegel
Bankruptcy lawyer at Siegel & Siegel, P.C.
Contact a lawyer to see what you should do.  In fact, you might be able to stay in the home for years without paying anyone, but you want to be on top of this situation.  Unless you want, you do not need to vacate now.  If you want to vacate, there are better ways to do it.

How does one stop wage garnishment?

Answered by attorney Dorothy G. Bunce (Unclaimed Profile)
Bankruptcy lawyer at A Fresh Start
There is no such thing as a best way to stop a wage garnishment. There are a number of choices and each comes with its own price tag. How much is the court judgment that led to the wage garnishment? What type of debt is the judgment for? Without more details, you might as well ask if it is better to order chicken or fish.

How can I get protection from my creditors after withdrawing from Bankruptcy?

Answered by attorney Mark J Markus
Bankruptcy lawyer at Law Office of Mark J. Markus
First of all, you can't "withdraw" a bankruptcy.  You can dismiss your case, but you will have filed a bankruptcy.   I'm not exactly sure what your question is.  If you are not in bankruptcy, you no longer have the protection of the automatic stay, so your creditors may take whatever legal actions are allowed under the laws of your state.   I'm not sure what "protection" you are seeking.  You can of course file bankruptcy again, assuming you are eligible, although if your case was dismissed within the past 12 months, then the automatic stay (preventing creditors from taking actions against you) will terminate 30 days after your bankruptcy case is filed.   This may not be a big deal in a Chapter 7 context, but it really depends on your situation.   You need to consult with a qualified bankruptcy attorney in your area. Mark Markus has been practicing exclusively bankruptcy law in California since 1991.  He is a Certified Specialist in Bankruptcy Law by the State Bar of California Board of Legal Specialization,  AV-Rated by martindale.com, and A+ rated by the Better Business Bureau.
