Mr. Berney showed up to trial totally unprepared. He was a total embarrassment. He never sent the subpoena out for the witnesses to show up to trial, then when he was caught he tried to blame the other side. He never listed our witnesses in discovery even though he had numerous chances to list their names, which meant we were unable to call the people we needed to testify. He didn’t review the opposing side’s exhibits, so he let them add in exhibits during trial that were never introduced into discovery— and those exhibits hurt my case. He was just awful all around.
