Medical Malpractice

Medical Malpractice is defined as the negligent and unskillful treatment of a patient by a doctor, pharmacist, or other health care specialist. A physician will be held liable for damages if he or she does not act with the same amount of reasonableness and skill any prudent qualified medical professional would have acted with under like circumstances.

There are four elements which a plaintiff must prove. The elements of a successful claim are:

  1. The physician owed a duty of care to the patient;
  2. The physician violated the same;
  3. Tthe patient suffered an injury; and
  4. The injury was caused as a result of the physician’s negligent treatment.
