David Stoller is the founder and principal of our firm. He is a graduate of the University of Michigan (Bachelor of Science 1992) and the Nova Southeastern University College of Law (Juris Doctor (cum laude) 1996).
Prior to entering private practice in 1999, Mr. Stoller was an Assistant District Counsel with the Immigration and Naturalization Service. In this capacity, Mr. Stoller's main focus was representing the federal government's interests before the United States Immigration Court and Board of Immigration Appeals. Mr. Stoller provided legal advice to the operational components of the Immigration and Naturalization Service. He provided guidance and counsel to Immigration Agents, Immigration Inspectors, Deportation Officers and District Adjudication Officers.
Mr. Stoller's main focus during his tenure with the Immigration and Naturalization Service was handling matters relating to individuals convicted of criminal offenses. He worked in the District Criminal Alien Program and traveled to county and state prisons and detention facilities to handle deportation proceedings conducted while individuals were incarcerated.
Mr. Stoller also represented the Immigration and Naturalization Service in non-detained settings. In this capacity he handled claims under the asylum laws, applications for permanent residency based on family and employment relationships, applications for waivers for individuals convicted of criminal offenses and applications for residency based on an individual having attained long periods of stay in the United States (cancellation of removal and suspension of deportation).
Since opening his own office, Mr. Stoller has represented hundreds of individuals before the Immigration and Naturalization Service (now the Bureau of Citizenship and Immigration Services), Immigration Court and the Board of Immigration Appeals. He has obtained asylum for individuals from countries including Albania, Bulgaria, Belarus, Colombia, Cuba, Eritrea, Haiti, Russia, Somalia and Ukraine. Mr. Stoller focuses his asylum representation on providing detailed declarations in support of individual applications and obtaining background material to support each claim. Many of the cases that he has successfully presented before the Immigration Court are cases initially denied by the Immigration and Naturalization Service or Bureau of Citizenship and Immigration Services.
As with his experience with the government, Mr. Stoller focuses his attention on immigration consequences of individuals convicted of criminal offenses. He has successfully represented individual claims for waivers of deportation before the Immigration Court. Mr. Stoller has experience with waivers under 212(h) and 212(c) of the Immigration and Nationality Act and has presented applications for cancellation of removal. As with asylum cases, Mr. Stoller concentrates on presenting a well-rounded picture of his clients to the Court in an effort to permit an individual to remain in the United States despite a troubled past.
Mr. Stoller also assists individuals with immigration holds or immigration detainers in moving their cases forward. This includes contacting the appropriate authorities to move an individual from a local or state detention facility to an immigration detention facility. Mr. Stoller has obtained immigration bonds for qualified individuals and assisted others with speedy deportation from the United States.
Because of his experience with the government and knowledge of immigration related criminal matters, Mr. Stoller is often contacted by other immigration practitioners to render legal advice in complex and difficult cases. As well, Mr. Stoller is in contact with the criminal defense bar in offering his opinion as to the immigration consequences of a proposed plea agreement.
Mr. Stoller also maintains a benefit related immigration practice. He has obtained permanent residency for dozens of individuals based on familial relationships. He has experience with all types of immigrant and nonimmigrant visas seeking to unite and reunite family members in the United States. He also handles more complicated cases dealing with individuals seeking to return to the United States after deportation or conviction.
Finally, Mr. Stoller has also developed an employment based immigration practice. He is knowledgeable in all types of immigrant and nonimmigrant visas based on offers of employment. This also includes individuals seeking to sponsor themselves for immigration to the United States based on their extraordinary or exceptional abilities.
Mr. Stoller is a member of the Florida Bar and the Bar of the Eleventh Circuit Court of Appeals.
