CLASS ACTIONS:

 

Our firm handles a wide variety of consumer and employment class actions and has recovered millions of dollars in relief for consumers and employees and has been successful in stopping unfair business practices on behalf of the general public.  The following are some of the cases we are currently handling or have successfully resolved:

 

  UNPAID OVERTIME / REST AND MEAL PERIOD VIOLATIONS 

 Over the past several years employee productivity has increased at the same time staffing levels and wages have dropped. In many instances this is due to employers improperly designating salaried employees as overtime exempt and requiring them to work long hours often more than 10-12 hours per day to do what it takes to get the job done.  Under California Law the presumption is that all employees are entitled to overtime compensation for all time worked in excess of 8 hours per day and 40 hous per week and there are strict guidelines governing which employees can be classified as overtime exempt.  Employees are also entitled to a 10 minute rest period for every 4 hours worked and a 30 minute meal period for every 5 hours worked.  If an employee is denied a rest period or meal period the employee is entitled to one hour of wages.

We currently have class actions for unpaid overtime compensation, and denial of rest and meal perods pending against Robinsons-May, The Vitamin Shoppe Inc., Lenscrafters Inc., and Tuesday Morning

  Class Action against GNC $4.62 Million Settlement  

Certified Class Action for unpaid overtime, denial of rest breaks and meal periods on behalf of Store Managers and Sr. Store Managers. Recovery of employees employed for entire class period est. in excess of $15,000 each.

     Class Action against Robinsons-May

Robinsons-May reportedly has the lowest ration of wages to sales volume in the retail industry.  We are currently handling a class action and approximately 50 individual cases against Robinsons-May for unpaid overtime compensation, illegal comp. time, denied rest and meal perods on behalf of Area Sales Managers.

     Class Action against Talent Tree Inc.  Class Settlement

Certified Class Action for unpaid overtime on behalf of Staffing Consultants and Sr. Staffing Consultants of a temporary employment staffing agency with stores throughout California.

     UNFAIR BUSINESS PRACTICES

        SBC (Pac Bell) Litigation Settlemet in excess of $60 Million

Class Action against SBC for deceptive advertising regarding the speed of SBC  DSL internet versus cable and unfair business practices.  Each SBC internet customer rececieved 1-2 months free service.

          Washington Mutal Litigation

Class action against Washington Mutual for violations of the Consumer Credit Reporting Act. Improperly reporting customers as delinquent on mortgage payments.

           TD Waterhouse Litigation

Representative Private Attorney General Action against TD Waterhouse for improperly terminating customers' access to its WebBroker internet stock trading service.

     INTERNET PRIVACY AND FALSE REPRESENTATIONS

Our firm is very concerned with preserving individual rights to privacy and stopping the practice of internet spying by companies and service providers and stopping the practice of misrepresentations by internet companies regarding the invasive nature of their services and software.

     RealNetworks Litigation  $20 Million settlement value to class

Our firm, filed the first lawsuit in the nation against RealNetworks for secretly attaching spyware to its RealJukebox software and assigning a GUID (Globally Unique Identifier) to its customers. 

     Aureate/Radiate Litigation  $2 Million Judgment

Our firm successfully litigated a class action against Auereate Media Inc. to stop it from secretly embedding spyware into shareware programs that allowed it to track consumers? internet usage without their authorization.  The case resulted in a $2 Million judgment and injunctive relief.

 

PERSONAL INJURY:

 

          Our firm is committed to aggressively litigating personal injury and wrongful death lawsuits on behalf of injured persons and their surviving relatives. We have successfully helped numerous injured persons recover monetary compensation for their injuries.  The following are some of the cases we are currently handling or have successfully resolved:

 

Oil Field Injury resulting when a pipe exploded during pressure testing. Total settlement $2.7 Million.

 

Cemetery Litigation  mishandling of human remains.  Our firm has extensive experience litigating improper maintenance and improper handling of human remains cases against cemeteries and mortuaries. Jeffrey Spencer represented his former firm as liaison counsel for the individual plaintiffs in the Paradise Memorial Park Cemetery Consolidated litigation.  Our firm recently reached a confidential settlement with a cemetery located in Los Angeles California of a family whose loved ones were buried in a desecrated grave sites, and  one of their loved ones was buried in a multiple grave without their consent.  We are currently representing individuals in cases against Woodlawn Memorial Park Cemetery seeking damages for the mishandling of their loved ones remains and for improper maintenance of the cemetery.

 

Auto Accidents
