HELPFUL TIPS IF YOU ARE IN AN ACCIDENT

1. At Work: Tell your supervisor immediately - don't wait, no matter how minor you think your injury is. Fill out a First Report of Injury which should be available right there at work, get the names and phone numbers of all persons who witnessed the injury. Remember, if you get hurt at work, nobody needs to be at fault in order to get Workers' Compensation. Simply stated, you only need to show that you hurt yourself while working.

2. In a Car: If you are severely hurt, wait for help to arrive. Make sure the police are contacted. Get the name, address, license and insurance information from the other party. Get names and phone numbers of any witnesses if possible. Contact your insurance carrier as soon as possible.

3. At a Retail Store: Inform the store manager or other store employee immediately. If you need assistance for your injuries, make sure the store contacts an ambulance for you. Get the names and addresses of any potential witnesses who saw the accident.

Automobile Accident *** $1,000,000.00 Arbitration Award

Severe head and leg injuries resulting from intersection accident, mild brain injury, permanent lower extremity impairment.

Uninsured Motorist Auto Accident *** $500,000.00 Settlement

Tractor-trailer driver swerves to avoid accident in his lane, truck becomes airborne, crosses median landing upside down. Driver suffers neck, knee, arm injuries and post-traumatic stress.

Motorcycle vs. Automobile *** $805,000.00 Mediation Settlement

Automobile made a u-turn in front of motorcyclist, causing motorcyclist to strike the side of the car, become airborne and land 25 feet away, causing multiple fractures and nerve root damage in neck causing partial paralysis in right arm.

Wrongful Death Case ***** $250,000.00 Settlement for her Estate

78 year old woman dies instantaneously as a result of an automobile accident. She left a surviving husband, 4 adult children, and numerous grandchildren. No medical bills, loss of earnings, or other special damages. No pain or suffering, the settlement was based on the value of a 78 year old woman's life, as well as a loss of consortium claim.

Automobile Accident ***** $150,000.00 Settlement

Case settled at mediation for $150,000.00 based on neck injuries. Claimant had pre-existing spinal stenosis and this injury-incident caused an exacerbation of her pre-existing condition which was asymptomatic prior to this injury-incident. She had cervical fusion at C5-C6.

Automobile Accident ***** $150,000.00 Settlement

Case settled at mediation for a woman with neck and shoulder injuries necessitating surgery. Liability was hotly contested as defense claimed the plaintiff caused the accident by passing vehicles on the right that were stopped to allow defendant to make a left-hand turn.
Motorcycle Accident ***** $130,000.00 Settlement

Motorcyclist injured in accident when car pulled out of side street and plaintiff was driving motorcycle too fast to stop in time. Injuries included lower extremity fractures and knee injury. Case was complicated by the fact that the motorcyclist was arrested for reckless operation of his motorcycle and for driving under the influence of a controlled substance.

BAYCOL SETTLEMENTS

Shaheen & Gordon recently settled cases for three (3) clients who had taken the cholesterol medication, Baycol. All 3 clients suffered rhabdomylosis resulting in having to be hospitalized for approximately one week and medical expenses of approximately $20,000.00. Each of the 3 clients received a settlement of more than $300,000.00.

CONSUMER PROTECTION

Shaheen & Gordon lawyers were recently involved in landmark consumer protection litigation on behalf of Massachusetts' consumers. Specifically Shaheen & Gordon represented Massachusetts' consumers in a claim against the Home Depot resulting from Home Depot's failure to affix prices to items in their stores in compliance with Massachusetts law. The case resulted in a multi-million dollar settlement and safeguards to ensure that Home Depot complies with the item pricing regulation in the future.

Premises Liability ***** $275,000.00 Settlement

Claimant was working as a delivery man delivering items to a supermarket. On exiting the store, after delivering the items, plaintiff fell on a crack in the ramp leading from the building. Plaintiff suffered a knee injury requiring several knee surgeries.

Automobile Accident ***** $550,000.00 Settlement

50-year old claimant eating lunch at Chiles when the defendant drove her vehicle through the wall of Chiles causing it to strike him inside Chiles and suffer a back injury. Claimant required back surgery and suffered a permanent injury to his back. The settlement was obtained from both the insurance company of the driver at fault and the claimant's underinsured motorist coverage.

Automobile Accident *** $160,000.00 Settlement

Serious injuries resulting from a rear-end car accident, including broken ribs, Horner's syndrome and concussion.

Automobile Accident *** $95,000.00 Settlement

Claimant pulls over due to icy road conditions and is struck from behind by another driver who also slides on ice. Claimant suffers soft tissue back and neck injuries.

Premises Liability*** $57,000.00 Settlement

Claimant went to Store 24 to purchase some items and upon exiting her vehicle, slipped on ice in the parking lot at Store 24 suffering back and knee injuries.
