Attorney Arpiar G. Saunders, Jr. awarded the E. Donald Dufresne Award for Outstanding Professionalism

The New Hampshire Bar Association will recognize Attorney Saunders at its Annual Meeting. The award is presented to an attorney that best fits the following description: “A professional lawyer is an expert in law pursuing a learned art in service to clients and in the spirit of public service; and engaging in these pursuits as part of a common calling to promote justice and public good.”

Attorney Saunders is a former Professor at Franklin Pierce Law Center . Currently, he is a Director and Member of the law firm of Shaheen & Gordon. He represents individuals and entities in a variety of business law matters. He is a long time member of the Hopkinton School Board.

The United States Court Of Appeals for the First Circuit held yesterday that a tenant’s minor children do not have standing to sue a landlord for failure to disclose information regarding the hazards of lead plaint under the Residential Lead-Based Paint Hazard Reduction Act (“RLPHRA”). See Mason et al. v. Morrisette et al., Slip Op. No. 04-1908 (April 7, 2005).

The plaintiffs resided in an apartment building in Franklin, New Hampshire from May 21, 1997 until July 2, 1998. On September 29, 1997, one minor child was found to have high levels of lead in her blood and the family was provided with emergency housing as a consequence. Thereafter, the minor children initiated suit against their landlord alleging violations of the RLPHRA.

Attorney Sean O’Connell represented the landlord and objected to the suit before the trial court. He argued that the minor children were not “lessees” for purposes of the Act and therefore had no standing to seek remedies under that statute. The trial court agreed and dismissed the suit. The plaintiffs appealed the trial court’s decision and the case made its way to the First Circuit Court of Appeals. Yesterday, the First Circuit affirmed the lower court’s holding and its dismissal of the case.

Shaheen Continues to Shine

CONCORD — There’s no doubt Democrats looking for a political win in New Hampshire start in Madbury, the home of former Gov. Jeanne Shaheen and her husband Bill.

The party’s biggest and brightest stars, as well as local politicians looking to trump the state’s GOP tradition begin their quest in the Shaheen camp, which has a track record of winning here in New Hampshire.

The record of success in the state dates back to the mid-70s when an unknown peanut farmer from Georgia garnered national headlines by winning New Hampshire’s first-in-the-nation presidential primary.

"We try to look for good people, people who can unite us. We try to look for what the country needs at the time," Bill Shaheen said Thursday morning.

Aside from running the New Hampshire campaign of Jimmy Carter in 1976, Jeanne Shaheen also ran a successful bid by Gary Hart, who beat the odds to win the state’s presidential primary in 1984. Shaheen has also been successful as a candidate by winning three straight terms as governor, a rare occurrence here for a Democrat.

Tuesday’s election was "bittersweet" for the Shaheens as their candidate John Kerry reversed a strong GOP trend here to edge out President George W. Bush for the state’s four electoral votes. However, Kerry lost the election on the national level.

Another Shaheen-backed Democrat John Lynch scored a historic win over one-term Republican Gov. Craig Benson. It was a one-two punch in the state with deep Republican roots.

"It was impressive for both Kerry and Lynch to win here on Tuesday. For Kerry, it was the first time in 40 years the state voted for a Democratic president. That’s even more significant considering the last time the state went for a Democrat was for LBJ (Lyndon Johnson) who was an incumbent," Bill Shaheen said. "The last time the state went for a Democratic challenger was probably 80 or even 100 years ago.

"In describing the Shaheen magic here in New Hampshire, Bill Shaheen said they look for candidates who are for reaching across party lines.

"What we look for is inclusion. We don’t believe to the victor goes all the spoils, but rather a president and a governor should be a uniter," he said. "It works in the primary and it works in the general election.

"Mark Bodi, a longtime Democratic activist and former finance chair for Jeanne Shaheen’s campaigns, said the former governor brings a unique skill-set to the table.

"Jeanne Shaheen is very unusual in that she has the skills of both a masterful political consultant as well as someone who served in public office and mastered public policy," Bodi said. "Most people can only master either being the person in front of the curtain, or the one behind it.

"When eight Democrats began filtering into the state two years ago for the presidential primary, all came knocking on the Shaheens’ door. It was a courtship which continued after Bill Shaheen took on the responsibility of Kerry’s state campaign manager while the former governor had yet to publicly endorse a candidate. In the end, Jeanne Shaheen signed on as Kerry’s national campaign chairwoman.

"Both Jeanne and Billy are really a potent political combination. Any candidate who has even a modicum of knowledge of New Hampshire politics will recognize one of the important early keys is having the support and backing of Jeanne and Billy Shaheen," Bodi said. "I suspect she’ll play a role in ensuing years and will be very involved. She is much more of a national figure today and it’s great to see she is so appreciated around the country and so respected. New Hampshire is lucky to share her talents around the country as she works for important Democrats and causes.

"Behind the Shaheens is a powerful machine, put together about 10 years ago as Jeanne Shaheen made her run for the corner office. One of the Shaheens’ top confidants is Judy Reardon, former gubernatorial legal counsel to Shaheen. Reardon acted as an advisor to the Kerry camp as well as taking a lead role in advising the Lynch campaign."

Judy Reardon really is a political streetfighter. She knows where the votes are and how to get them to the polls in order to wage a winning campaign," Bodi said. "She has been one of the top stars in the party over the last decade.

"There is also Rich Sigel, former chief of staff for the Shaheen administration, who took a lead role in the Lynch campaign. While the nation did not follow New Hampshire’s lead, political observers and activists agree the Shaheen team continue to alter the political landscape in the Granite State.

"There’s no doubt Jeanne Shaheen and some of her close friends, like Judy Reardon and Rich Sigel, have a phenomenal understanding of New Hampshire voters and New Hampshire politics," said Jim Demers, a Concord lobbyist and former Democratic candidate for Congress. "They masterminded a great victory when Jeanne Shaheen ran for governor the first time. They have a brilliant understanding of what it takes for a Democrat to win here in New Hampshire.

"So what’s next? Bill Shaheen wasn’t saying.

"We’re just going to take some time to reflect on all that’s happened," Bill Shaheen said.

As for the next presidential race in 2008, Bill Shaheen said, "I don’t even want to talk about that at this point."

Shaheen & Gordon is plaintiff’s counsel in 2 wrongful death cases arising from the FBI’s handling of confidential informants Whitey Bulger and Stephen Flemmi. The cases allege that in the early 1980s, the FBI leaked the fact of Brian Halloran and John McIntyre’s cooperation with government agents against Bulger and Flemmi so that Halloran and McIntyre would be murdered.

Bill Christie was recently appointed lead plaintiffs’ counsel for the consolidated cases pending in the United States District Court for the District of Massachusetts arising from the FBI’s relationship with Whitey Bulger and Stephen Flemmi.

In a major decision issued by the First Circuit Court of Appeals, Bill Christie and Steve Gordon recently obtained a reversal of a lower court decision when the federal appeals court reinstated the McIntyres’ wrongful death claim against the United States Government. The firm expects that these cases will now go to trial in Federal District Court in Boston, Massachusetts. The decision in McIntyre v. United States can be found at 367 F.3d 38, 2004 WL 104544.

Arpiar Saunders moderated a panel discussion of the U.S. Patriot Act, a portion of the Privacy Rights program sponsored by the New Hampshire Bar Association held on November 5, 2003. Panel participants included attorneys from the United States Attorney and the New Hampshire Attorney General Offices, the New Hampshire State librarian, a member of the New Hampshire Public Defender Program, as well as the Executive Director of the New Hampshire Civil Liberties Union. The ensuing USA Patriot Act debate between panel members resulted in active audience participation. In addition to the Patriot Act, the discussion also touched on proposed amendments to the Act currently being debated in Congress. Arpy was chosen to moderate the discussion based on his law school teaching of Constitutional Law and his litigation experiences addressing privacy matters.

Arpiar Saunders has recently been involved in several commercial transactions including representation of a startup company that was acquired by a publicly traded entity and the representation of parties involved in the purchase and sale of vehicle franchises. In these transactions, Arpy represented the sellers through the negotiation process and drafting of documents.

In a challenging assignment, Arpy is assisting a local college wind down its operations. Arpy is involved in probate court proceedings with regard to restricted assets, negotiation with various creditors and contract holders as well as addressing student related concerns.

Within the past several months, Arpy has been busy dealing with eminent domain matters including issues about the preservation and taking of historical barns and the impact on clients of a significant land taking by the State related to the interstate highway system.

Arpy continues to represent Optima Health, the former holding company for Catholic Medical Center and Elliot Hospital. Pursuant to agreement, disaffiliation has been successfully negotiated and approved by the Probate Court. At this time, Arpy is involved in related litigation on behalf of Optima in the state court system. Arpy successfully defended Optima Health in an employment discrimination claim before both the Federal District Court and First Circuit Court of Appeals.

Arpy has a very active federal court practice including local representation of Anheuser-Busch, Incorporated in a successful trademark infringement matter, assistance to The May Department Stores addressing ADA related challenges, and providing representation on a joint basis to Moore North America and a Senior Moore North America employee obtaining an order absolving his client in a commercial purchase and sale dispute.

Recent state court activities undertaken by Arpy include successful N.H. Supreme Court appeals which clarified landlord-tenant law as well as a dismissal of a wrongful termination claim filed by a professional employee against a client.

Steve Gordon and Arpiar Saunders have recently successfully represented Anheuser-Busch in a trademark infringement suit filed in Federal District Court. The final victory was coupled with an earlier victory where the Court granted summary judgment to a variety of counterclaims brought by the defendant.

During the September 2003 First Circuit Judicial Conference, Steve Gordon's work as an evaluator for the Appeals Court Criminal Justice Panel was recognized by Chief Justice Boudin.

In the October 2003 New Hampshire Magazine listing the "ideal" New Hampshire attorney, as voted by lawyers throughout the State, Steve was recognized in two categories: "Complex Litigation" and "Criminal Law".

Steve Gordon was also recently nominated by his peers to appear in a London based publication entitled "The International Who's Who of Business Crime Lawyers 2003.

Eugene A. DiMariano recently won a decision for a client at the New Hampshire Workers' Compensation Appeals Board that will provide the client with an in-home hot tub to help her alleviate her injuries and pain that she suffers from as a result of a Workers' Compensation injury-incident. Not only does the decision indicate that the Workers' Compensation carrier have to pay for the cost of the in-home hot tub, but it also has to pay for a 3-seasons addition to claimant's home that will house the hot tub. It is believed that this is the first decision of its kind in New Hampshire.

Attorney DiMariano has recently authored materials and was a featured speaker at a recent seminar for paralegals entitled "Essential Litigation Skills for the New Hampshire Paralegal".

In an unprecedented decision, the New Hampshire Supreme Court on January 7, 2003 enjoined the swearing-in of John Coughlin who was elected Hillsborough County Attorney in November 2002. Steve Gordon, represented the incumbent, Peter McDonough, in a challenge as to the constitutionality of New Hampshire's use of the straight party ticket. The New Hampshire Supreme Court has accepted the challenge and set argument on an expedited basis for January 29, 2003.

Spring 2001 On March 8, 2001, Shaheen & Gordon filed a wrongful death lawsuit in federal court in Massachusetts on behalf of the Estate of John L. McIntyre against the United States of America, eight former agents of the Boston Office of the Federal Bureau of Investigation and James Bulger, Stephen Flemmi and Kevin Weeks. The lawsuit alleges that former agents of the FBI conspired to protect and shield from prosecution known organized crime figures, James Bulger and Stephen Flemmi, in exchange for Bulger and Flemmi's agreements to provide information to aid the FBI in the prosecution of Bulger and Flemmi's competitors in the Boston, Massachusetts organized crime market. The lawsuit alleges that in 1984 John McIntyre agreed to cooperate with the FBI regarding the illegal activities of Bulger and Flemmi. Six Weeks later McIntyre was kidnapped, tortured and murdered. The lawsuit charges that the United States is liable for the acts or omissions of FBI agents who improperly protected Bulger and Flemmi and whose negligence was cause of McIntyre's wrongful death. The lawsuit demands $50,000,000 in damages.
