BIRTH INJURY
Most births are joyous events and all goes well. However, about three times in every hundred births, there is some type of serious birth injury. Not all birth injuries are due to medical negligence. If the medical treatment fell below the medical standard of care and if the negligence caused the birth injury, then there may be a case.
To determine if a birth injury was caused by negligence, all the medical records need to be obtained and reviewed. An expert needs to review the records, a summary of the records should be made and the medical literature often needs to be collected to determine whether the case has merit. The process can take several months. Since the cases are very difficult, expensive to win and are fought strenuously by our opponents -- our firm must turn down far more cases than we take. However, when our firm believes we can prove a serious birth injury was caused by negligence we do everything we can to obtain a successful outcome for the family and child.
MEDICAL NEGLIGENCE:
When a health care professional or hospital makes a mistake that causes injury or death, it is commonly referred to as medical negligence.
All bad outcomes are not the result of medical negligence and not all medical mistakes cause injury. However, serious injuries do result from medical negligence.

Dental negligence cases are just as expensive and difficult to try as medical negligence cases, so a serious permanent injury is needed to justify and merit bringing a dental negligence case. Serious dental injury cases our firm has been involved in include lingual and inferior alveolar nerve injuries and antibiotic or pre-medication errors. As with medical and birth injuries, our firm ends up turning down far more of these cases than we can take.
WRONGFUL DEATH:
