One-ton truck collides with motorcycle on residential street. Defendant contended unlicensed motorcycle driver caused collision by speeding and was on the wrong side of the street. Plaintiff contended truck crossed over the center of roadway in a curve, and struck motorcycle. Motorcycle driver sustained a crushed injury to the left leg, 30-day hospitalization and amputation of left leg below knee. Plaintiff rejected a settlement offer of 1.2 million dollars. A 30-day jury trial resulted in a verdict of $4,268,000.00.
DeOca v. Brown, Los Angeles Superior Court, 1994
Intersection collision between Plaintiff, a 23 years old unlicensed motorcycle rider, and an automobile driven by an attorney. Disputed liability as to who had the green light.
Motorcycle rider sustained multiple fractures to right arm and leg requiring open reduction and internal fixation surgery. Case settled for $1,000,000.00 before trial.
Gibson v. Parties Plus, Inc., Los Angeles Superior Court, 1995
$850,000.00 verdict for injuries in a freeway accident after a diesel fuel spill. Without proving exactly what the Defendant driver did that was negligent, attorney demonstrated that the defense theory, based on losing control when van drove through a diesel fuel spill was invalid. Plaintiff, with use of expert witnesses at trial, proved that loss of control was due to driver error and not fuel spill on the roadway.
Barnes v. Anders, Ventura County Superior Court, 1996
Defendant lost control of his vehicle on the freeway after a rain storm. The Plaintiff claimed Defendant was driving at an unsafe speed for conditions. Defendant contended loss of control due to uneven road surface. Injury included broken ribs and post concussion syndrome. Settlement for auto insurance policy limits of $100,000.00.
