The Jamieson Law Firm provides legal services to clients. This may appear to be redundant or self-evident but it is not. Many providers of real estate closing services now refer to themselves as "closing agents". This means, quite simply, that they can and often do represent a number of parties to the transaction and have no fiduciary-level duty to provide service to you.

To provide fiduciary level service is to provide the highest level of care and service to a client and includes the duty to always act in the best interest of the client, to preserve his confidences,to act with extreme care and diligence at all times on his matters and to always provide advice and counsel where necessary.

These are traditionally services provided in a good attorney client relationship. The problem is that in recent years the real estate industry has changed rapidly as to the level of representation. For example, Realtors in many

states (including Tennessee) can elect to serve in a "Transactional" or "Facilitator" role which allows them to represent multiple parties in the same transaction and does not require the observance of the fiduciary duties referenced above. The same applies for "closing agents" who may or may not represent your interest at a closing.

The Jamieson Law Firm proudly provides fiduciary level service to our clients. This is consistant with our education and experience and is what our clients expect and deserve. Any person contemplating a real estate transaction should carefully investigate the level of service and obligations to him from the number of providers involved be they closing agents, realtors or lenders.   

The determination of the need for legal services and the choice of a lawyer are extremely important decisions and should not be based solely upon advertisements, certification, specialization or self-proclaimed expertise.
