Q. How long do I have to file a lawsuit if I have been injured?

A. All States set strict time limits to begin a lawsuit after you have been hurt. Each limitations period is different based upon the facts of your case. It is important to contact us immediately so we may protect your interests.

Q. What steps should I take following a car accident?

A. There are many steps you should take following a car accident. Here are some of the more important steps you should take: 

 Determine the medical needs of all persons involved and remove yourself from immediate danger.

 Call for medical attention as needed.

 Call the police and insist upon the completion of a police accident report.

 Exchange personal information with all drivers involved in the accident.

 Always take down the color, make, model, State of registration, and license plate number of all cars in the accident.

 Get the names, addresses and phone numbers of any witnesses at the accident scene.

 Do not make statements about accident except to the police. Make sure you explain to the police any fault of the other driver.

 Photograph the damage to your vehicle prior to repairs being made.

 Advise your doctor of all the injuries you have sustained.

Q. What is a case worth?

A. Much has been, and can be, written about how to value of a claim. Insurance carriers and attorneys use various methods to evaluate a claim. Some even use computer programs. However, the real marketplace for determining the value of a claim is in the courtroom. Therefore, in attempting to predict the value of a claim, it is important to consult with an attorney experienced in the litigation field. Some of the different factors to considered are: (1) the nature and extent of the injuries, for example: whether they are temporary or permanent; the amount and kind of medical treatment received; and whether such injuries have disabled a person from work, etc.; (2) the amount of fault the defendant played in causing the injury; (3) the amount of fault of the plaintiff, if any; (4) the amount of the plaintiff's expenses and losses; and (5) the type of case and potential statutory limits of damages.

Q. I was seriously hurt in an accident, but I can't come to your office because of my injuries. Can I still bring a lawsuit?

Q. How do you select an attorney?

A. It may come as a surprise, but many lawyers who advertise their services have little or no courtroom experience. When you have a serious legal matter, it is important to discuss your case with a veteran trial lawyer. Most of the time personal injury cases are handled on a contingent fee basis. This means the attorney will be paid a percentage of the amounts obtained on your behalf at the time of the judgment or settlement. If there is no recovery, there are no attorney fees. Additionally, in some cases, attorneys will be prepared to advance the expense of the litigation.

When choosing an attorney, it is advisable to find out about the attorney's experience in personal injury/insurance litigation and the track record of the firm in actual jury trials. It is advisable to hire an attorney who has a successful trial history. You are more likely to have a better outcome by retaining an experienced trial lawyer with a proven track record rather than hiring an inexperienced attorney who only rarely has been to court, but who may be willing to charge a lower percentage contingent fee or hourly rate.
