These actions include, though are not limited to, those sounding in Contract, Corporate Law, Real Estate, Fraud, Defamation, and Defendant?s Medical Malpractice.
We also have a special expertise in the area of Matrimonial Law, and are fully versed in all aspects of Matrimonial Litigation and related areas, including, though not limited to, the negotiating and drafting of Ante-Nuptial, Post-Nuptial and Separation Agreements, Equitable Distribution, Child Custody/Visitation and Support, Maintenance, and Paternity. Elliot R. Polland, the head of our Litigation Department, is a Fellow of the American Academy of Matrimonial Lawyers and has been so since 1981. Our matrimonial attorneys are thoroughly abreast of all current developments in matrimonial law such as the case law which governs the consideration of professional licenses, practices and careers as marital property pursuant to the landmark New York Court of Appeals holding of O?Brien v. O?Brien.
Our attorneys are admitted to the bars of State and Federal Courts, including the United States Supreme Court, and also litigate before the American Arbitration Association, Board of Regents and Office of Professional Discipline, as well as other administrative agencies where appropriate. It has a strong and experienced Appellate Practice and is fully adept in the drafting of appellate briefs and the argument of appeals before the Appellate Courts.
Resolution of law suits by way of settlement most favorable to the client, or by means of an application for summary judgment, is actively pursued where plausible. Where such options are not available, or their prospect is premature, the Firm engages in the full panoply of pretrial litigation in thorough preparation for trial, such as depositions, written demands for discovery, motion practice, analyses of expert evaluations and appearances at Court conferences.
Our attorneys have veteran trial experience and will rigorously try the case where circumstances indicate. The Firm drafts all post-trial memoranda of law and other post-trial documents, and makes all appropriate post-trial applications as well as engages in the prosecution and/or defense of any appeal as noted above.
