My career has encompassed a wide range of legal work including the representation of the United States of America in some of the first asbestos cases filed by Pittsburgh Corning Corporation in the Eastern District of Texas. Additionally, I filed and successfully tried the first land condemnation cases in the Big Thicket National Preserve and West Hackberry Strategic Petroleum Reserve Projects. I have successfully represented numerous plaintiffs and defendants in complex litigation in Federal and State Courts, as well as appeals to the United States Circuit Courts in cases involving insurance coverage questions and other civil matters.

INJURIES FROM PRESCRIPTION MEDICATIONS

 

Manufacturing and pharmaceutical companies, specifically the makers of Vioxx, owe consumers a duty to assure that their medications and products are reasonably safe when used as intended. Too often, drug companies will manufacture an unreasonably dangerous product by failing to properly research possible risks before placing it on the market.  In such cases, without being warned before using the drug, people serve as unsuspecting guinea pigs.  A drug's approval by the Food and Drug Administration is not a guarantee of its safety, nor does it shield a drug company from liability.

 

Before your doctor prescribes a drug to you, he or she is duty-bound to inform you of the drug's risks, so that you are capable of making an informed decision in determining whether or not to take the drug.  If your doctor fails in his or her duty to relay the manufacturer's warning, responsibility usually will lie with your doctor, not the drug manufacturer.

 

In seeking to recover damages from a drug manufacturer for injuries caused by medications, the theories of product liability (strict liability, negligence, breach of warranty) are applicable. If your doctor's conduct is to blame, a negligence suit in medical malpractice would be justified.

 

Drug makers and physicians who prescribe drugs, hold positions of trust and consumers/patients rely very heavily on their doctor's advice.  The drug companies and physicians should thus expect that if their negligence causes damage, they will be held responsible.
