The firm has successfully handled complex civil litigation matters which have resulted in substantial damage awards for their clients. This includes $10,000,000.00 in the Coordinated Fertility Litigation and $7,500,000.00 in the UCI Liver Transplant Litigation. In these matters, Mr. Eisenberg was appointed Lead Counsel by the Orange County Superior Court. Other awards are in excess of $5,000,000.00 in railroad injury cases against Southern Pacific and Union Pacific Railroad.
The firm emphasizes representation of consumers and injured victims in cases involving negligence and wrongful conduct. The firm has achieved excellent results in motor vehicle cases ($1,800,000.00 in a head-on collision), trucking accident cases ($1,300,000.00 in a tractor trailer accident); negligence at a construction site ($1,800,000.00 for burn injures in an electrical explosion); and medical malpractice cases ($4,000,000.00 for a 3 year-old due to the failure to diagnose a neurological disorder). In addition, we have represented clients against the Kaiser Health Plan including former patients at the closed Kaiser Kidney Transplant Program in San Francisco.
Mr. Eisenberg is a Member of the Bar of California, New York, Massachusetts and Washington State; American Board of Trial Advocates (ABOTA) since 1996 and was President of the Orange County Trial Lawyers Association in 1993. Mr. Eisenberg received the 2007 Orange County Trial Lawyers Association Trial Lawyer of the Year Award in Medical Malpractice. Mr. Eisenberg is a frequent lecturer in trial advocacy and the effective presentation of evidence.

LEAD COUNSEL AND LITIGATION RESULTS:
Mr. Eisenberg was appointed by the Court as Lead Counsel in the UC Irvine Liver Transplant Litigation involving patients who were wrongfully denied liver transplants resulting in settlements of $7,500,000.00 in 2007.
Mr. Eisenberg was appointed by the Court as Liaison Counsel in the UC Irvine Coordinated Fertility Cases involving patients whose eggs and embryos were misappropriated resulting in settlements of $10,000,000.00 in 1997.
The firm has achieved excellent results in motor vehicle, truck and train accident cases:
- $1.8 million dollars for a 30 year-old gentleman in a rollover vehicle collision;
- $1.3 million dollars for a 17 year-old boy seriously injured when he was ejected from his vehicle in a tractor trailer truck accident;
- Awards in excess of $5 million dollars against Southern Pacific and Union Pacific Railroad;
- $935,000 for a woman pedestrian who suffered two broken legs when hit by a truck;
- $600,000 for a 59 year-old woman with head and neck injuries in a tractor trailer truck accident;
- $600,000 award for a dentist and his son injured in an underinsured motorist case.
Results in other significant cases include:
· $1.8 million dollars awarded to an electrician who received serious burn injuries in a construction site explosion;
· $800,000 for the wrongful death of an 11 year-old boy due to negligence/lack of supervision at an outdoor camp;
· $500,000 for a 70 year-old woman who had a serious leg injury in a premises liability/trip and fall case;
· Damage awards for 100 women with silicone breast implants.
Results in medical malpractice cases include:
- $4 million dollar settlement to be paid over the lifetime of a 3 year-old child regarding the failure to diagnose a neurological disorder;
- Settlements in excess of $1 million dollars for two patients who were victims of neurosurgery malpractice which caused bleeding in the brain. The settlements were negotiated during the jury trial of the first case;
- $900,000 award for the wrongful death of a 44 year-old gentleman due to the failure to diagnose an abdominal injury;
- $600,000 settlement for the wrongful death of a 54 year-old gentleman from cardiac arrest during back surgery as a result of the failure to diagnose his underlying heart condition;
- The firm has also handled numerous cases against the Kaiser Health Plan including former patients at the closed Kaiser Kidney Transplant Program in San Francisco.
