Barry T. Simons has spent the last 30 YEARS specializing in defending DUI cases in all Courts in Orange County, California. His cases include successful challanges in both trial and appellate courts to DUI Roadblocks; Preliminary Alcohol Screening Tests (PAS Tests); DMV Procededures and practices; and refusals of chemical tests.
Over the last several years, he has successfully challanged the Irvine Police Department's practice of compelling blood tests from DUI arrestees in Nelson v. City of Irvine in the 9th Circuit Federal Court of Appeals. This case established for the first time that an arrestee has a constitutional right to choose a breath test and that police cannot compel a blood test from an driver who wants a breath test except under unusual circumstances.
In Trautman v. Department of Vehicles, Mr. Simons was responsible for exposing the Orange County Crime Lab's use of an unlicensed breath test device in over 4700 DUI Cases all across Southern California.
Mr. Simons has gained a reputation for his fights for the constitutional rights for DUI Defendants. His clients include Doctors, Lawyers, Entertainers and Athletes.
