RECENT NOTEWORTHY CASES

 

State of N.H. v. M. M., Rockingham County Superior Court.  Mr. MacDuff was charged with Aggravated Felonious Sexual Assault (Rape).  This case went to trial during which the complaining witness, while being cross-examined by Attorney Andrew Cotrupi, chose to end her participation in the trial.  Due to her unwillingness to continue in the trial and at Attorney Cotrupi's request, her testimony was stricken from the record.  Attorney Cotrupi orally requested the case be dismissed, the State objected and the Presiding Judge took the matter under advisement.  Moments later the following order was entered:

"The complaining witness terminated her participation in the trial during cross-examination. Accordingly, and by agreement of counsel, her testimony was stricken from the record in its entirety.

 

Both the State & Defendant then rested and the Court considered Defendant's Motion To Dismiss. For the reasons set forth on the record, the case is dismissed."

 

 

State of N.H. v. B. R., Rockingham County Superior Court.  Mr. Robbins was charged with  Felonious Sexual Assault.  This matter proceeded to trial at the conclusion of which a "not guilty" verdict was entered by the jury.
