Civil Rights. On behalf of his clients, Attorney Weakland has asserted and defended claims of race, gender and national origin discrimination under the Civil Rights Act of 1964; of free speech discrimination under the First Amendment; of handicap discrimination under the Americans with Disabilities Act, and of retaliation under state and federal "whistleblower" laws. He has sued several law enforcement agencies in Florida for violations of civil rights.

Employment Discrimination. Attorney Weakland has represented employees in public and private sector employment discrimination cases in federal and state courts. He has brought and defended claims under Title VII of the Civil Rights Act, Age Discrimination in Employment Act, Americans with Disabilities Act, Family and Medical Leave Act and Florida's worker's compensation laws. He has also represented clients in breach of employment contract cases and in "non-compete" agreement cases.

In addition, Attorney Weakland has counseled employers on the intricacies of federal, state and local employment discrimination laws, and provides to employers "audits" of their procedures and practices to lessen the employer's risk of liability when employment decisions are made.

Medical Malpractice. The office has handled a variety of medical malpractice cases, involving negligent diagnoses, careless abdominal surgery, dental malpractice, negligent spinal surgery, substandard nursing care, improper medications and inattention to patient needs.

General Civil Litigation.

Attorney Weakland has an active litigation practice that includes significant negligence cases, wrongful death cases, small business litigation and probate matters. His trial experience is rooted in his federal clerkship and extended for several years through a number of federal criminal defense trials and serves as a Criminal Justice Act panel member.
