  1. Can "Dad" Stop Paying Child Support When the Kid Isn't His?(29-DEC-09)

My husband has a 9 year old daughter, and his ex-wife just told him she is not his, but that he can't do anything about paying child support because it has been over 6 years. My husband loves his daughter, but it is unfair for him to be paying for someone else's child. I understand if someone KNOWS for 6 years and chooses to stay, but in this case, my husband was duped into thinking it was his child. We are in CA. Is there anything my husband can do to fight this?

  2. Can I Get Child Support From Lawsuit Settlement?(15-DEC-09)

My husband and I are not together, (not legally separated either) we have 2 children 5 and 3 years old he has been ordered to pay $25 a month for child support because he was not working. However he just received a personal injury settlement in the amount of $80,000 and only had to pay me $400.00 dollars for the arrears. Are my children or myself entitled to any of that money? Can I sue him for child support on the settlement? I am still legally his wife.

  3. Can my new spouse adopt my child?(08-DEC-09)

I was married and I had a child with my now ex-wife. We got divorced and I got sole custody of my daughter. I haven't heard or seen from my ex-wife in 6 years. I remarried and would like my current wife to adopt my daughter since my current wife is the only mother my daughter has known. I do not get, nor have ever received, any child support from ex-wife. What should I do and how should I go about it? My divorce and custody was in Massachusetts and I have resided in New Hampshire for the past 6 years.

  4. A Parent's Rights And Responsibilities Prior To Court(08-DEC-09)

Our son and his wife have been separated over a year. No divorce papers have been filed. Our son has a live-in companion, and he has been laid off from work for a while. He has been recently served with child support papers. However, she has denied him any visitation with his children. Can she withhold visitation from him? She is trying to get him to sign over his parental rights, which he does not want to do. When he goes for his court date, can this be brought up that she has denied visitation? Also, she is living with someone and she has our grandchildren call this new man "daddy." The little girl told him, "Daddy, we have a new Daddy." The mother allowed us as grandparents to see the children twice in this period, but she recently has denied us visitation as well when we refused to pay for our son's half of the divorce as she wanted. What can we do?

  8. One Night Stand You'll Now Remember Forever(16-JUN-09)

I just found out from a girl i had a one-night stand with that she is pregnant, and the baby is mine. I have offered to help her with adoption but refuses to give up the baby, she assured me she would raise it alone and not need my help. How would I go about terminating my parental rights? I have no way of supporting the child and have told the mother as such.

  9. Boyfriend Locked Away in Jail(02-JUN-09)

My boyfriend has been jailed for both criminal contempt and civil contempt for failure to appear for his child custody issue court date. They have sentenced him to serve 180 days PLUS to remain in jail until he pays the FULL amount he is in arrears!!!!!

Everyone says to get a good attorney, but I don't have that kind of money nor does he. He can't get legal aide because he is in jail. No one will talk to me unless I hire them, which I don't have money to retain them. Not only is he in jail 6hrs away from him home, but he is in a small town that his Ex and her family is very prominent. And the DA now, was Ex's attorney for divorce (good old buddy type town).

I have been told by some "new" attorney's that they don't know how to help him until they try to keep him beyond the 180 days. He can't address visitation modification and child support modifications until he is released. They tell me I should hire an experienced lawyer!! We can't even seem to get answer if they will release him after 180 days (June 20), or if they will keep him in there beyond until he pays full arrears!

How can anyone be indefinitely confined without given chance to work to make payments?

We offered Ex my tax refund ($1000) towards what he owes, if she would allow him to be released to start paying what he owes. She of course not only refused, but wants him to give up his PATERNAL Rights!

    PLEASE, ANYone help!!!

  10. Can I Make Dad Sign Divorce Papers?(05-MAY-09)

I am having a hard time getting custody/parenting papers signed with my ex. One of the hold ups is that he wants to claim our daughter on his taxes. Can he do this, is it normal? She will be with me 75% of the time.

Also in regard to child support. He is not claiming all his income (he claims pt income) also, he gets a monthly GI bill for school, will the state factor that into the order amount? Finally how do I go about making him verify his income?

  11. Step-Parent Adoption(14-APR-09)

My husband wants to adopt my 12 year old daughter. Her father has not been in contact with her in over 5 years, I am not even sure where he is. I do get child support randomly (maybe twice a year).

How do I got about terminating my daughters bio-father rights? Are there forms I can file with the state myself? Also what happens with the back due child support (over 32k now!!) Does that get erased?

  12. Dealing With Deadbeat Dad(11-NOV-08)

After our separation, my ex-husband stayed in WV and our son and I moved to my home state of MT. He is $3,000 ($200/mos) behind on child support and dropped health insurance in May 2007. We get maybe one phone call a month and no other correspondence. When is he considered a deadbeat dad? Does he still have any parental rights or is this a breach of our divorce? Basically, if he shows up to get him, can he? Thank you.

  13. Social Security Disability Payments and Child Support(07-OCT-08)

Does Social Security Disability paid to the custodial parent for a child from the benefits of the non-custodial parent go towards child support payments? (California)

My ex-spouse received a lump sum payment of $9,900.00 plus approximately $800.00 beginning next month. My disability ruling was just finalized and she is asking for all medical records to prove I am disabled. Am I required to supply this to her?.

  14. Can Absent Mom Get Equal Time Parenting?(09-SEP-08)

My ex-wife lives in Florida and I live in Canada. She left 6 years ago and has not seen our 10 year old son in 3 years. Whenever I bring up the topic of child support she threatens to go to court to take my son to live with her 6 months out of the year so she won't have to pay. Is it possible that a judge would grant this and make my son go live with her when he hasn't seen her in 3 years and she only calls once every couple of months? She reminds me all the time how the United States court system isn't the same as Canada's. My son is also a special needs child (ADHD), in counseling and sees a specialist every 3 months. We do have joint custody but I am the primary care giver. Are her rights abolished since she abandoned him 6 years ago?

Hello. I just had a question about a deadbeat mom. Iwas wondering what I could do about her. I have being polite to her for the last 12 years by asking her to pay at least $50-100 dollars a month and she has not done that. I don't want her thrown in jail or have her license taken away but maybe get her income tax refund or garnishment every month. Is that possible?

  17. Can I Volunteer To Give Up My Parental Rights?(17-JUN-08)

Can a mother give up her parental rights; would she still have to pay child support?

  18. When Can I Cut Dad's Rights Off?(13-MAY-08)

My question is: What do I do if the father of my child hasn't had anything to do with the child since he was three weeks old? I have had good contact information for him but he still will not help out. I don't want him to pay child support; I just want full rights to my son. Currently, my child is in another state with his grandparents. We are trying to allow my son to go on vacation to another country with them but I cannot get him to sign the paperwork to allow it. What rights do I have and what rights does he have?

  19. Can I Go Back And Collect Child Support?(08-APR-08)

My question deals with child support. I was ordered by the court to receive $692.00 a month for child support. My ex-spouse only paid $600.00 per month for about 15 years, stating he couldn't afford $692.00. Is it possible for me to get the back child support at this point in time?

  21. Dad's A Semi-Deadbeat; Can New Husband Adopt Children?(26-FEB-08)

My ex husband and I have been divorced for 7 years and we have a daughter who is 9. He has paid child support only because it is taken out of his check by the state. Every time he switches companies, 4 times this year, there is a long intentional delay in support payments. Just recently, he relocated out of state from Illinois to Portland, violating his visitation and joint custody agreement. We have a court order stating he is supposed to have her 3-4 days a week but now he moved 2,000 miles away. He hasn't paid anything in over 4 weeks for child support. Is there something I can do to enforce his visitation or can my husband now adopt her since my ex hates paying support and moved so far away?

  22. Dad Stationed Overseas(29-JAN-08)

My husband got served with papers to modify child support in June 2007. He left for Iraq October 2007 and he won't be back until January 2009. If his lawyer represents him will the court only go by the what they already have and he just makes a new modification when he comes back to cover Iraq or will they go by his Iraq pay now and he will have to request it to be lowered when he returns?

I can never get a hold of his lawyer so I am forced to ask the question here because my husband wants to know.

  24. Child Support For A Love Child?(25-DEC-07)

I'm in an unusual situation in Virginia and I'm not sure how to handle it. My husband and I separated a year ago and we both started dating other people. We decided to attempt to reconcile, which has worked, but before we reconciled I discovered I was pregnant by the ex-boyfriend. The father wants to be involved. Can I ask for child support? I want him to be able to visit, but not be able to take the baby overnight, as I plan to breastfeed for the first year. The other two things that I want: No smoking around the baby and I do not want his mother and stepfather to be able to care for the baby alone. She's on her second DUI and they are both (barely) functional alcoholics. This is a serious safety concern, not a dislike of the woman (I do like her).

  25. My Kid Detests Me; Can I Stop Paying Child Support?(27-NOV-07)
Do I have to pay child support if my child does not want to have any contact with me? I read that in the state of New York this is possible.
